If the letter is from Concentrix, then I guess it is tax credits.

HMRC seem to make this claim on the basis of linked financial records at the same address.
At this stage, they don't really look at the other criteria for assessing if someone has a partner living with them.
The fact that your ex is in another relationship, does not live with you, and has a child with his new partner - should be fairly conclusive. Give them all the info you can to show this.
If your ex won't help, is their anyone else who could confirm this in writing?

There has been some recent caselaw which casts doubt on the HMRC method of using financial info to establish relationship links (because it takes time after to split financial footprints after relationships end). This caselaw would help you and the CAB if you need to take it to a tribunal.

However, I do think you need now to take active steps to detach your ex from any links to your address.

    Thank you all for replying.

Yes the letter is from HMRC and its regarding tax credits. I'm unsure what portion of the tax credits it relates to as I only receive CTC (with a premium due to having a disabled child).

Im annoyed at myself regarding the car insurance - like I said he always asks me to do things for him and sort stuff out so I got him a cheap quote then he asked me to book it and so I did. It's hard to explain but he makes my life difficult if I don't do things when he asks me to.

I've no idea if new girlfriend is claiming anything as a single parent - there is a possibility I guess.

I've taken all the steps that I can - when he moved out I removed him from the rent agreement, electerol roll etc. The things that remain are in his name so only he can change the address.

I have today text him with details of the agreements that are still in my address and asked him to change them asap - I have not received a response so he's still not talking to me but he has read the message, I can see that.

From now on any post in his name will be returned to sender. I will send back the documentation asked for and see what happens from there. Hopefully I will not lose any money.

I know I should press for child maintenance but the money just seems like another reason to have a "hold" over me. I don't like being threatened with the removal of it at whim. Hopefully i will be back at work within a year and able to do without anyway.

Thank you all again for replying

Why don't you go through CSA? HMRC would expect to see maintenance of you are separated.

To add - I am on good terms with his mother (who knows what he can be like and what he has done in the past towards me) - do you think its worth sending a letter back with the documentation from her, confirming that he is resident in new address and has a relationship etc? She wouldn't tell him, I'm sure of that.

Or should I see what the outcome of my documentation is first?

I didn't go through CSA as we had a private agreement (fully disclosed to anyone who asked for it).

I suppose I could in the future . . .at this point I refuse to ask him for another penny. This mess he has landed me in is the final straw on top of everything else.

You would have had to provide his address and where the car will normally be kept to enable the Insurance company to provide a quote. Did you give your address as his home address ?

    Yes I (stupidly) did.

I did an online quote (in his name but using this address). It was a yearly one off payment so he asked me to pay it for him (transferred money into my account) and I paid it using my debit or credit card.

The policy ends in July so won't be renewing again but obviously concerned about this one. Cannot believe I did it now, looking back. There is always a price to pay for being a coward I guess. I knew something like this would happen but was too scared to enforce it.

CTC makes up a large part of my income at present (£500 per month). Losing that (plus a possible fine) together with the £300 a month child maintenance will make life impossible. And I cannot work right now as have no one to look after my child during school holidays, I'm the only person who can do it. Feeling so low right now - I spend the majority of my life alone, care alone for a disabled child (throughout the night too) and now this.

Never heard of tax credits doing this.

It will not be from Tax credits, it will be from the local council HB investigations team.

If he can prove he is paying council tax at his own residence he will be in the clear quite quickly.

These departments work closely together with information and this is a preform check before the serious stuff starts.

His not my problem attitude will soon change if they suspect joint housing benefit fraud.

The OP need to think this through very carefully and make sure the story checks out, it will have to.

Hi small update so far -

My ex has provided me (today and totally out of the blue) with a council tax statement and rental agreement for his address which shows both his and his girlfriend's names on.

Will be sending this with my bundle of documentation.

Also as they have a baby, are they claiming tax credits? It should be slam dunk proof that he's not your parnter if he's claiming tax credits jointly with his new gf!
