    The problem is this is second device that has broken and they refused me a replacement or a refund when as stated at the beginning a lady came in with a cracked apple logo on her iPhone on the 24th and refused to leave the shop and received a brand new iPhone

    I was told that by Barbara at the John Lewis store yesterday when i visited.

    She apologised for the problems that i have been having but insisted it has to go back to CAD yet again with respect to John Lewis i can't keep being without a phone for weeks at a time when they insist on sending it back i would of been happy with a new iPhone or just to get my money back so i can get a new phone that actually works...i have been told it's a hardware issue.

    You'd had your phone 7 months and 2 months, you say the ladies was brand new. Maybe she bought it only the day before?

    Hers had physical damage unlikely to be user caused, yours has a battery/software issue.

    Basically what happened to her is irrelevant to you. I imagine the CA was just making conversation about the problems they'd been having with iPhones. If apple sent them a cracked phone JL certainly isn't making a £700 loss.

    All that you are legally entitled to is a replacement, and that's what you got before, or a refund which could take into account over 9 months use. You could press for the refund or take another replacement, but they have to see what the fault is first, which happens at the CAD. A crack in the phone doesn't need a CAD appt, so maybe that's why this mysterious lady got hers fixed quicker.

    Not annoyed what so ever think it's disgraceful that they keep having to send my Phone off when people can buy a iPhone in the shop claim there is a crack on the Apple Logo and walk out with a new iPhone (Which she bought on that day)!

    Don't know about anybody else but i don't have £699 to keep shelling out on a new iPhone when my one from them goes belly up.

    No ones asking you to buy a new one.

    If she had just bought it and there was a crack, of course she'd want a new one. What's wrong with that? If I spent £700 on an iPhone and opened it and there was a crack, I wouldn't leave the shop until they swapped it over. You say she bought it that day? All the more reason to swap it!

    Yours has issues after 7 and 2 months. You could have dropped it in the sea. You could have thrown it down the stairs. They have to verify the faults as you can't 'see' them. They can't see it switching off and the battery draining. They need to verify it.

    She claimed there was an immediate crack. You can look at that and see a crack

    You're claiming the battery is wonky (after 2 months) with out you doing anything wrong: you can't look and verify it

    Book an appointment at the Genius Bar at your nearest Apple Store and your phone will be sorted out there and then, no need to wait weeks

    Just spoken to the manager at John Lewis he has sincerely apologised and given me £70 as a good will gesture and if this new Phone breaks they will give me a brand new one out of the shop instead of from CAD.
