Gym membership cancellation

Looking for a bit of advice.
My son signed up to an imotion gym in the next town. Their opening offer for membership was £10.99 a month. He and his friend signed on the same day with people from the gym in town opening offer. It was all computerised sign up. Few days later he went to the gym but hadn't received any confirmation email and had to be given a pin number there so he could enter. Direct debits have been taken for £12.99 per month. He has only been 3 or 4 times since. He has decided to cancel the membership. He emailed an enquiries email address given on their website giving notice of the cancellation, all he could see on the website was a 30 day notice. I called the gym to see if there was a specific procedure to follow and to get contact info for the company that takes the direct debits. I was told on the phone that because he was over 18 when starting the direct debit he couldn't cancel it????? I mentioned he had no info pack/email and the price was different to which he just apologised on behalf of the gym. He did ask for my son to forward the email onto them directly and they would pass it on to the regional manager to see if the membership could be cancelled.
Has anyone had dealing with imotion? Any advice as to how we should proceed? Advice most welcome....learning curve for his first unmonitored financial transactions....

  • So when he went, did he sign an agreement?

If he did, he is bound by those terms - it could be a 12 month membership instead of a rolling membership where the 30 day terms may apply.

You really cannot get this answered without knowing the t&Cs he signed up to, and the only people who can give your son that is the gym.

    Thanks for your reply.
He had no paperwork to bring away with him. It was all computerised although he did have to write down his name and address. He can't really remember anything else as it was 4 months ago.
Waiting for the gym to get back regarding the email he sent about cancelling the membership.

Firstly, it is for your son to sort out - if he is over 18, then it is his problem, let him sort it out.

Secondly, doesn't matter what was sent, you need the terms and conditions that he agreed to. He's also the only person who can sort it out, so get him to do so. If he agreed to a 12 month membership without a cancellation clause (common T&Cs) then he has to pay for the contract.

OP, has your son checked his emails? If he signed up online it's more than likely he would have been sent an emailed copy of the t's and c's and should be able to get more of an idea of what the rules are. Otherwise, contact the company again and ask them to resend the terms and conditions to your son so he can take a better look at them.

Go with him to the gym and speak to somebody face to face. Ask to see the T&C and find out how long he is tied in for.

Give notice accordingly and ask for a receipt.
