I'm familiar of past dishonest activities of this PPC. But does that have any bearing now in relation to my case? Is it worth even mentioning this in my POPLA appeal?

Yes. Mention the previous doctoring of photos by UKPC that got them banned from obtaining keeper details from the DVLA, and state that therefore any pictures they provide in evidence cannot be believed as true and accurate representations.
If you have your own photos you can actually compare them with the ones sent by UKPC to show they are different or non BPA CoP compliant.

That's an excellent point, the only one I think I missed that proves the NTK is invalid according to POFA 2012. I'm pretty sure the NTK I received only mentioned the time that the PCN was issued.

You will have to quote the relevant part of POFA 2012 to the PoPLA assessor and spell out that the NTK has to comply with each and every point, not just bits of each.

One single omission means the NTK fails, but we have seen some bad decisions by PoPLA assessors so you will have to lead them by the nose.

"This is what it must say ... Here is what it actually says ... This bit has been missed ... therefore it is non-compliant." It is the law.

You need to add, lack of grace period to your appeal.

The BPA CoP states a period before parking and a minimum of eleven minutes after the parking period.

Also mention that one of the car's occupants was a disabled person with their blue badge on display. The BPA CoP mentions the operator should allow more time for people with disabilities, so quote that as another appeal point.

Thank you all for the excellent advice. I have finished my appeal statement and submitted it.

Have to say, the POPLA appeal submission process isn't exactly straight forward. Just have to wait and see what happens now. I'll report back when I get a decision.
  • Great News! Thank you all so much for the advice given :-)

UK Parking Control Ltd have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

    Yours sincerely

    Nice one! Well done.

We've just seen that TommyG5 and his friend both beat UKPC in court as well this week!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
