The NtK is clearly non-compliant with POFA 2012, for example note that there is no "period of parking", just "date of event", like the NtD. I invite board members to play "non-compliance bingo" and see how many they can find
Your best bet is to find the POPLA decision from a couple of months ago which stated why POPLA felt the NTK was non-compliant. Use POPLA's own words! It was in the POPLA Decisions thread, might have been me posting a pepipoo link...I definitely KNOW we've had POPLA decide on this NTK.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks, C-M, I had actually seen that one (I think you're referring to this, although in my case it's POFA para 8 not 9) and I agree, it's very useful. My NtK also does not say that "the driver is liable for the parking charge", merely that "the Parking Charge is now payable". But I had missed the second point about the NtK omitting "beginning with the day after that on which the notice to keeper is given", so I will add that to my list, and keep to the POPLA wording where possible (in case I have to appeal a bad POPLA decision). Yes - you seem to be the sort of person who is experienced & confident enough about these scam PCNs, to send a different appeal.But in this case there is a valid case for appeal, and so I am minded to increase the chances that F1rst will cancel before POPLA.
I would do your version - just don't imply who was driving of course and remove any plan to use 'no GPEOL' which is dead as a do-do thanks to the Supreme Court lapping up PE's version of commercial justification.
Yes but H0riz0n do cancel PCNs on mitigating circs. They are my fave PPC as they are surprisingly normal and - dare I say - fair with their responses.Two years ago I got a cancellation at the PPC appeal stage from Horizon Parking by using the (then, pre-Beavis) MSE recommendations, and the case wasn't nearly as strong as this one.
You never know till you try! I've just remembered, I did appeal one for my DD's friend at their University last year (fluttering permit but not Nottingham) and F1rst cancelled it immediately. The friend thought it was because I showed she had a permit all along but I believe F1rst cancelled because I included detailed stuff about the POFA, like you are proposing. I didn't use a template. I've tried to find the appeal I used but it seems I deleted it last year, once won.
