They all seem to be ignoring that the simplest remedy would be for the smokers to move away from that position, which would help their neighbours. Instead they seem to be delighting in telling our asthmatic OP that 'you can't make me do it', without any ounce of sympathy or any helpful remedy.

I think the OP was mainly looking for legal advice rather than sympathy. I would also find such behaviour by neighbours to be annoying, but I doubt a court would find a normal domestic consumption of fags to constitute a nuisance.0 -
My neighbour's chimney pumps out thick black smoke every day from about 3pm on. It's like being at a bonfire. I have to make sure I've no laundry on the washing line by then and keep windows shut. It's made me have more sympathy for people years ago in smog cloaked cities. Must have been horrendous!
I'd happily swap for a few people having a cigarette.0 -
Being a non smoker, I can sympathise with the OP; it's amazing how the smell of smoke can permeate even through shut windows. My neighbour's chimney pumps out thick black smoke every day from about 3pm on. We don't have the problem with smokers, but unfortunately we're surrounded by pyromaniacs, who tend to light bonfires at the slightest provocation. I can almost guarantee on a nice sunny day, when I've put my washing on the line and it would be a pleasure to sit in the garden, someone will light a stinking bonfire. It's not even immediate neighbours; the smoke travels in the wind for quite a distance. To be fair, by and large they're reasonable neighbours, whom I would be loathe to upset, so we tend to put up with it, for the sake of a quiet life.A cunning plan, Baldrick? Whatever it was, it's got to be better than pretending to be mad; after all, who'd notice another mad person around here?.......Edmund Blackadder.0
