Notice to quit question regarding date

Hi,
I received notice to quit my property which states the following

"I give you notice under section 21 of the Housing act 1998 that i require possession of the dwelling house known as (my address)

after 24/06/2016
or, if this notice would otherwise be ineffective, after the earliest date and not earlier than two months after the date of service of this notice when shall expire a period of the assured shorthold tenancy
Dated 15 April 2016

The signature below this was dated 20/04/2016"

Now does this mean if I wished that I could move out on 16 June 2016 as this is the earliest date or is it 24/06/2016 which is the date given in the letter

    It is not a "Notice to Quit". An s21 is not an NTQ.

    An s21 does not end the tenancy nor require you to leave.

    You, separately, can issue your own NTQ which must end on the last day of a tenancy period.

    However as the landlord wants you out he would presumably be willing to agree an early "surrender" ending whenever you both agree, say 16th June or, indeed, this afternoon at 15:35 if that's what you are BOTH happy with.

    Technically you should serve your own notice, as a s.21 does not end a tenancy.


    Your own notice would run (presumably rental periods are 25th-24th) to the 24th June, if you served notice today.

    Your correct rental period runs 25th to the 24th

    I assumed (wrongly it seems) that this was notice to quit and I have agreed to leave the property now. I am hoping to end the tenancy on the 16th but will hand deliver a letter tonight terminating lease on 24th June

    I would start by asking if you can leave earlier, but if not then yes serve your own notice

    You can usually mutually agree to leave at any time.

    The LL wants the property back so offer it back whenever you want. It's very likely the offer will be accepted.

    As advised you should hand in a notice ending the tenancy on the 24th so it ends then if the offer of handing it back now is not accepted.

    Why?

    Why not ring the landlord (or invite him to tea and cake?) and say

    "Hi. I understand you want the property back. That's no problem. I've got somewhere to move to. Perhaps we can agree to end the tenancy on 16th June as that would suit me and you'd get the property back sooner. Is that OK?"

    If he says yes, get that date confirmed in writing.

    If he says no, then serve your formal notice with the correct date as described above.
