Claiming unregistered land

Hello there,


Behind my garden is a patch of land which I believe used to be a footpath many many years ago. All across the street, other houses have claimed this land (some into their deeds via adverse possession I would assume and some just in practicality rather than in registration).


Now I would do the same, however when we once cut down an over-hanging branch from this land (it is in terrible condition - hugely overgrown) a neighbour who also backs onto this land, claims it is his.


I've checked and the land is unregistered (also not his) and not owned by the council.


I couldn't make an adverse claim as he will likely object, but is there anyway to claim it? Could I just clear the land and fence it off - am I right in thinking only the true owner can evict me then - so the neighbours complaints would be for nothing?


Just to note we previously talked to the neighbour and asked him to clear the land a bit as it has ripped down our fence by becoming so overgrown, he said yes and did nothing for 2 years, so I'm not inclined to ask again.

    This might be your land anyway, as most houses had a back way in for trades people.
    http://www.gardenlaw.co.uk/ would be better place to ask.

    With regards to your neighbour if he is claiming this land ask him to remove the tree as it is dangerous. Put him on notice that you will claim all costs from him if the tree comes down and damages your land / house / children.
