Potential missing leasehold deeds for property we're in the process of buying as FTBs

    I would have thought that extra work in this case should be paid for by the seller's solicitor not the OP.

    I think I would get on to the agent selling the house saying if this is not resolved soon you will have to pull out and give the sellers an incentive to chase their solicitors.

    In the meantime I would ask for viewings of other places and tell your solicitor to do no more work for the moment.
  • Our solicitors haven't done any searches yet. I'm sure there would be some charges for the work they've done so far. I e-mailed the estate agent last night and got this reply:

    "Hi
    Yes he (the vendor) has been into see me today also had an update from Solicitors they are still on with it but looking like (the vendor) will pay to get them replaced (NOT CHEAP) !!!!!!
    Should know more next week
    Teresa"

    So I basically made it clear we know it's not just as simple as she puts, "getting them replaced" and that we're apprehensive of the (what seems to be) high potential the deeds are lost and the implications of what we assume would be a reconstructed possessory title, rather than absolute title. Hopefully that's put our point across for now!

    It would just be gutting because there's not much on the market in the area we want that matches our criteria at the minute :(
