Housing Benefit Query

My current situation at the moment is, I've had two temporary jobs and have claimed JSA between late November 2015 to mid January 2016, and now since April 2016.

I claim £210 a fortnight JSA (enhanced due to being disabled) and £86 DLA a month on the lowest rate (mobility). I took over my partner's claim for 12 months after his death (Oct 2014 to 2015) and was awarded £393 a month Housing Benefit - his was more as he was on medium DLA and ESA support and was 32 year old when he died.

I've noticed, I only get £67 a week Housing Benefit, and I have to try and find £130 a month, even if I am registered disabled. It's becoming a struggle, as I have a phone line for the landline and internet and I have to go short every month. My rent is £400 a month.

Is there any way I can get this looked into?

    I am guessing here so please correct me if I am wrong.

    Your partner was claiming for both of you as a couple and therefore you were entitled to the one bed rate of LHA (nothing to do with his DLA/ESA support group)

    You received the 52 weeks bereavement protection when he passed away which meant the one bed rate continued to be paid.

    Now the 52 weeks have come to an end you are only eligible for the shared accommodation rate (ie. you are under 35?)

    If you were living alone and received the middle rate of DLA or the daily living of PIP then, if no one received Carer's Allowance for you then you would be entitled to the Severe Disability Premium (extra money) as part of your JSA claim.

    If you received this then you would be eligible for the one bed rate of LHA.

    So, do you have care needs?

    Presuming you don't then you have two options:

    Apply for a Discretionary Housing Payment (form from local council)
    Find a room in a shared house.

    How long is your tenancy agreement? Is it fixed term or periodic (month to month?) Is there any reason why you couldn't move to a shared house?

    i dont understand the enhanced rate of JSA either.
    i thought it was the care component of DLA/PIP that added the premiums?

    I'm 31 years old, and that's exactly correct. I do suffer with anxiety and depression and the DLA claim is indefinite. I've been here for four years, and have a very understanding and caring landlord who always looks out and listens to me. My tenancy agreement is six months rolling.

    I wouldn't want to live in a shared house in my town as all the druggies, alkies and crims/dealers live in them. We're not called Weston-super-Rehab as a bad joke. It really is a bad town. I can't live with my Mum as her house is two bedroom and she was a bedroom tax victim hence a move to a smaller place, and my sister has four kids in a three bedroom house.

  • Whoops me reading g too fast and thinking DLA Care was in payment!

    SRR rate of LHA correct after 1 years bereavement protection.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    If rent is £400 pm and you get £290pm (£67 pw) then that leaves you £110 pm to pay out of your £514 pm JSA and DLA.

    What are your other outgoings?

    Also shouldn't your DLA be £94 per month as its £21.80 per week? Or have you actually quoted the 4 weekly amount?
