    Actually, in this case, I think hoodoo has made a rare mistake in saying that it is not a GPEOL case.

    The letter from the PPC reads
    Mr Robertson states "I had bought a ticket covering my time parked so KPS had not lost any revenue. The charge is not to cover the loss of revenue from the Pay and Display machine. The charged is based on a genuine pre-estimate of loss incurred by KPS as a direct result of issuing a PCN. We do not have to prove this loss as our charge is within the guidelines of the BPA code of practice"

    This does open the door for OP to demand that PPC proves that loss and certainly is a valid point should it get to court

    Can I ask...now do you think we should wait until my husband gets taken to court and for us to demand that PPC prove that loss....My husband is just back from hospital, bed bound and in no condition to address this...

    KPS have never done a court case in their life, and probably wouldn't know where to start. It would cost them around £250 - £300 in order to recover £100. You don't need a degree in 'sums' to do the math on that one.

    Their dodgy 'company' situation is probably more than sufficient to deter them contemplating a claim.

    Even if your appeal is turned down at POPLA, the decision is not binding on you.

    In that event the likely next steps will be a series of irritating debt collector letters, which are totally ignorable - they can't do anything other than send further begging letters. Don't worry about them if it does come to that stage. Read the newbies sticky, post #4 for information on dealing with debt collectors.

    as HOOHOO has made a great effort in helping here, it appears your "predictive texts" messages are using the wrong word, ie:- hoodoo , which is one method of dealing with this ;)

    well done to all the responders and I hope the OP continues to fight this bully at KPS or mickey mouse parking scammer as its "better known" , lol

    Firstly the PPC will have to prove there was an initial loss before he can claim for the costs of issuing the PCN.

    On a very similar note, I have received a PCN demand letter from Kernow Parking Solutions. I was all set to appeal to them, when I noticed on KPS' page at the BMPA.eu site that they recommend not appealing, and also state KPS havent taken anyone to court yet to date. On this basis do you recommend I appeal through KPS and POPLA or should I just ignore the demand for payment?

    What I do recommend is that you start your own thread for your case, rather than resurrecting and hijacking someone else's old thread. You can always reference back to this one if you need to.
