Asked for CCA - they want more details. Help!

    I repeat the advice already given - do NOT supply this information. They have obviously found you and have, in some way best known to them, linked your name to a 'debt' that they have latched on to in the hope of making some 'easy money'. Debt Collectors, in contravention of the OFT Guidelines on Debt Collection, will often write to everyone, on the electoral register, who shares the same surname as the original 'debtor' in the hope of 'netting' either the original 'debtor' or somebody who is too frightened of the threatened consequences of 'ignoring their letter' and will pay up to get the debt collector off of their back.

    Quite simply the Consumer Credit Act, 1974, states that if a creditor does not supply a true copy of the original signed consumer credit agreement within 12 working days of receipt of the cca request, then that agreement is no longer enforceable without applying to the courts.

    A credit agreement that is NOT properly documented, and signed by the customer, is totally unenforceable under the Consumer Credit Act 1974.

    The obligation to supply the cca applies to ANYONE attempting to pursue the 'alleged debt' whether or not they are the original creditor.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    My 12+2 day request for the CCA are up on Monday. Naturally I haven't given in to their request for "further information".

    Looks like there's no CCA available.

    Will keep you posted.

    Just to confirm. If my CCA request was received on Monday 3rd September, should I have received it by yesterday ; Monday 17th September or today Tuesday 18th September? Still no sign of it as yet...............

    Pablo, If you still havent received it then go ahead and send the second letter. You have given the time needed to provide the information they are legally bound to provide you and if they havent done so then THEY are in default and have commited an offence.

    They are quick enough to point the finger at us if we dont stick to deadlines so dont let them get away with it. The law works both ways and is not just a tool for creditors to threaten people. We have every right to receive the info we request and if they cannot provide it then report them to the OFT

    Sorry to dig this post up again, but I am in a very similar situation.

    However, the creditor requests my previous 3 addresses. They state that this information is required in order that they are not in breach of the data protection act.

    This is in reply to a request for a CCA. I must point out however, I have not been entirely organised and have not kept proof of postage, nor have I sent any postal order.

    What should I do? Should I re-send one with a postal order and proof of postage, and keep all receipts?

    Or wait the 12+2+30?

    Should this information be sent, or should I ignore this letter.
