I think im in trouble

Hi

I would really appreciate your advice. I stopped working last july. I called the tax credit office in september to let them know i stopped working but I didnt have My NI number. I was supposed to call back with ni but i forgot. I called them again last Month telling them i was still reciving the Money. They stopped the credit and will send Me Some papers but im scared what the coseqences Will be. I was overpayed 2100 pounds. I can pay this Back immediately but im Just so scared of prosecution.

    You should stop worrying

    You have willingly told them, albeit late and they wont prosecute if you pay up straightaway;

    The sooner you do it the sooner you will have peace of mind

    they can issue a penalty, but it isn't a criminal things and wont be held on record against you

    If you stopped working in July you should have informed them in July, not September. Failing to contact them again for another 6 months means that it's highly likely that you will receive a fine on top of having to repay the overpayment. As nannytone says, it's not a criminal thing unless they decide there was deliberate intent to defraud. It would be very difficult to prove that in your case as you did contact them twice.

    If you google tax credit prosecution policy you will see you are below the threshold for prosecution.
