Oh.
Well, lenders tend not to chase statue barred debts, or if the amount remaining isn't worth their while.
You could also make a full and final settlement offer.0 -
Can they legally go for me if its statue barred debt? Just need a little guidance.0

However if a small payment has been made at any point in the last 6 years, it won't be statute barred.......
Statute barring comes 6 years from the date of last payment.💙💛 💔0 -
Right -i'm not sure when the last payment was made especially since the debt was past from one collector to another i think. However i can call to ask them the question - but my worry is that if i call them they I come up on there list to pester me more!
I suppose im best waiting until the heat (if) it builds up.
I owe around 6K.0 -
For £6k, you'd be better off writing to them asking them to prove liability for the debt, then getting further advice here when you've done that.
It's a large amount of money, and well worth their time attempting to collect it.💙💛 💔0 -
right - well let them crank the heat up first.
Im in no position to pay it off atm. - furthermore i dont want to enter a payment plan.
What do i need to look out for in the letters to know they are serious - a court letter?0 -
Spoke to Cabot - apparently i had made payments back in 2013 to a previous company which had the debt and according to them its not statuary barred. However they did confirm the default has come and gone.
I've asked them for the credit agreement and payment history - they offered me a huge chuck of the debt off but its something i cannot afford, they were eager to get me on a payment plan but im doing nothing until seeing all the documentation which they agreed to.
Not sure what to do - can i get another default for the debt or further makers on my credit file?0
