Insurance company paying for write-off

I own a bike who I allow my god brother to ride, if he told the insurance company he's the owner of the bike and the bike got written off then wouldn't they request to see proof of ownership for the bike?
My god brother thinks it's a good idea for him to keep the money since he was involved in the bike being written-off and I would like to take the insurance company to court for lack of attention.
I also called and told them to say he's not the owner of the bike and they said things like "so" and "there's nothing we can do about that" they know me as the guarantor for the insurance yet they didn't want to give me any information on what the status of the cheque was and to top that because the insurance got cancelled the company had the audacity to call me 3 times a day asking me to pay the cancellation fee

When the policy was taken out, what was advised to Insurers about the bikes ownership ?The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -

Policy Holder - God brother
God brother says he owns the bike but if a company is going to pay for a vehicle write-off to prevent fraud you would require the logbook right?0 -
From what I understand here you loaned the bike to someone (!!!!!! is a god brother) ??? and he paid the insurance, its now been written off, he paid the insurance so the insurance company pay him.
That's quite correct
however its up to you now to chase replacement of the bike, that's between you and him, the insurance company is out of the equation0 -

You want the money for the bike you'll have to take action against him,0 -
He hasn't cashed out the cheque and I've tried to speak to them that they should cancel it but they said they wouldn't.0

With regards to your questions, the insurers will only pay the policyholder, it is then up to the policyholder to pay the owner.
I am surprised that they haven't asked for the V5C, or at least the relevant part of it, however, it's been some time since I had a vehicle written off and the "logbook" has been through at least a couple of incarnations between then and the present V5C. Maybe, now that everything is computerised, it's not needed since they can inform DVLA directly?
Anyway, the fact that someone is named on the V5C only shows them as the registered keeper, not necessarily the legal owner. To give a common example, many people "buy" vehicles on PCP deals. The person who "bought" the vehicle will be on the V5C as the registered keeper but, until they have paid off the finance, the finance company is the legal owner of the vehicle.0 -

Why should they just take your word for it? You allowed him to use your bike and allowed him to insure it. You should have told him to tell the insurer to note you as owner when the policy was taken out.
I think you would be wasting your time taking the insurer to court for 'lack of attention'. You have no contract with them so you would need to prove a tortious loss. As guarantor, the only necessary contact between you and the insurer is payment of premium.
Your problem is with him, not the insurer.0 -

its his cheque. not yours he paid the policy0
