UKPC Car Parking Charge 2016

Hi,

I'm hoping someone can help. I recently overstayed on a car park at a retail park in Burnley. The maximum time limit on the car park is 2 hours (I know this because I have used it many times). I paid £0.00 to park, it is a free car park.

On 26th March, according to UKPC's car parking charge, I entered the car park at 9.58am and exited at 13.36. By my own calculations that's an overstay of 1hr 38mins. Which did happen.

I received my first letter from UKPC on 1st April. It stated I parked there for 3 hrs 37 minutes and that I overstayed by 2hrs 11 minutes, which is obviously completely inaccurate. They were charging me £60.

I researched a little and ignored it, based on information that they are not a local authority and therefore cannot legally enforce me to pay.

The second letter came (Final Reminder) on 18th April asking for £100.00 and threatening County Court Proceedings if I didn't pay.

Again I ignored based on the same information, and I also researched they had only taken 16 people to court this year out of 42,000 charges issued.

On 4th May I received a letter from Debt Recovery Plus Ltd trying to threaten me to pay £160 by 18th May 2016, but all they would do is advise UKPC to continue with court proceedings if I didn't pay.

I am planning to ignore this as I go on holiday on 14th May and am fully expecting a solicitors letter when I return.

I'm not paying based on the fact I always use the car park, it's only once I've overstayed, they got their calculations wrong, and I paid nothing to park there, so they've not lost anything financially from me parking over by 1hr 38 mins.

I've since been told by a friend who has (unfortunately) been taken to court that rules changed as of November last year and that it's in my best interests to pay.

Just want some up to date info on whether I should ignore it and wait for the court summons or just cough up?

    Welcome, it's not a free car park, you get 2 hrs and thereafter these scammers try to extort money from you.

    Was this a ticket placed on your car ? assume it was
    Were you shopping at the retail park and have you got receipt or proof of purchase ?

    You say an overstay of 1hr 38mins. Which did happen.

    The letter claims you overstayed by 2hrs 11 minutes

    The claim must be identical to the ticket

    UKPC have already been caught out doctoring pictures and were banned by the DVLA FOR NEARLY 3 MONTHS

    You should find pictures online at their web site.
    These you must study and they must be date/time stamped and must be the same as a ticket

    As far as Debt Recovery Plus Ltd, these are toothless debt collectors with no power, regardless what these idiots say with their threats, only UKPC could take you to court which they do but will they win ?
    Probably UKPC use DRP on a "no win no fee basis" and they are extracting the urine out of DRP

    That's the daftest reason for not paying I have read for a long time. It defies logic.

    However, you should study the NEWBIES sticky thread and realise that, should this get to court, you will need a procedural/technical defence based on signage, failure of the NtK or similar. It is a pity you didn't appeal within the timeframe.

    You now face Debt Collector letters, solicitor letters etc all of which are toothless unless you get a genuine court claim. It is then that ou will need a decent reason to submit as your defence, so do check all the paperwork, signage etc and read section 4 of POFA.

    The letter refers to a case Parking eye V Beavis and states a supreme court has ruled that it is enforceable.
    Ive read it but tbh you need to be a legal eagle to understand it.
