Excel parking court papers!!!

Hi all! I'm hoping someone can help me! Today after 5 years of listening Money saving expert and avoiding any correspondence from Excel Parking.. I've received official documents from the courts which I have to return within 14 days in regards to the fines received 5 years ago! I was under the assumption that they could not take court action for these fines... Can anyone help me as this has come out of the blue and can't find any information saying that anyone else has actually been taken to court for parking fines by Excel..

    Plenty of people are taken to small claims court, but they are easy to beat.

    5 years ago is 2011, so was this before October 2012? If so, they've got no way for the keeper (you) to be held liable. As it was so long ago, you can't be expected to remember who was driving.

    1. Are you absolutely certain these are genuine court papers i.e. from Northampton County Court, with a court seal? And not just threats or fakes from some debt collector?

    2. Are you are saying that these charges (not fines) were incurred prior to October 2012?

    I suspect your username gives away your identity . Under no circumstances reveal on here who was driving ( or even hinting at it ) , be it you or anyone else .
    As these tickets were incurred prior to Oct 2012 only the driver can possibly be liable for them which without evidence Excel have no idea whether that was you or anyone else .
    If you could write in your defence "I was not the driver and as this event predates the introduction of The Protection of Freedoms Act in 2012 I cannot be held liable as Registered Keeper for the alleged charge" that is all you would need to write to kill it.
    If you cannot write that ( don't say here) then you defend on the basis that the car was driven by multiple drivers (if it was) and as this event was 5 years ago you have no idea who was driving on the material date . Without the identity of the driver they have no valid claim

    You can put the pressure on and write to them informing them that, if they lose in court, you will be onvoicing them for your wime in dealing with this matter.


    A litigant in person is entitled to claim £19.00 an hour, for revisiting the site, and research. In your case you need to be up to speed on the relevant parts of POFA, perhaps attend a few cases at your local county court, and browse a few of these fora.


    Then of course there is the photocopying, the limo hire to the court, postage etc. It all adds up.
    You never know how far you can go until you go too far.

    If it does, then probably a good idea to edit your post to remove all detail, get a new (completely anonymous) username and post again.

    I really do think we need a "IMPORTANT: Before you post..." sticky to warn users not to risk identifying themselves or their case by posting with an identifiable username, exact times of parking events, exact amount of claims etc etc. that could easily link a forum poster to a particular case.

    This is especially important for those with court claims.

    Too many new posters unwittingly give away too much information to the PPCs that do read the forum - I think stark warnings about this need to be made as clear as possible at the outset.
