Looks like Alfa nominated Clarkson as the driver when they should have nominated him as the hirer. ie on the reply they put down clarkson as driving when they could not be 100% sure it was him. If they had nominated clarkson as the hirer then the onus would then have been on him to disclose details of the driver.

IMO speeding was the wrong charge to try to pin on Clarkson.
One that would have stuck would have been 'being a huge prat'.
An appropiate punishment would be a ban for life from TV, magazines and papers.

The only problem with making that an offense is that it would necessitate at least a 1year + 1day sentence in prison, all MP's and politicians would be sent there and excluded from further service.... Hang on, that's a brilliant idea!
