Default Notification Process

I received a default on my Cahoot card in May 2013, for just missing 2 payments because they took Direct Debits early. I then increased my payments to make up the shortfall only to find 6 months later they had served a default on my account and not notified me. When I contacted them at the time they said they had sent me letters and everything had been done correctly. I have since been making payments to the account and almost cleared the balance.
Today I receive a letter notifying me that they had originally did not serve me with an arrear notice and because of this were refunding me the charges and interest because of a system error.
My question is now, because the first part of the default process was clearly missing, which they have admitted to can I get the default removed completely ?

Yes you can, they have not followed the process for giving you a default correctly.
challenge them and then ask for compensation for the fact they have damaged your credit file for a period of 3 years.
state this has affected you receiving competitive credit offers etc.
I had the same situation with Santander due them not sending me a letter about a default the gave me £250 and remove the default
they did however leave the late payments on there.0 -
You probably have a good case to get the default removed as your account is now by the sound of it in good standing. Did they send you a notice of intent to default and give you a time frame to pay the account to avoid default0
