policey holder not reported inccident so insurance saying they will not pay out until

Hi all this is my first post and I hope its in the correct place.
the company I am talking about is premier underwriting ltd or premier claims service
basically a man hit my car while stationary but he was caught on camera by one of my children so there is video evidence of him doing the damage.
a long story short
I reported it to the police and it took 10+ weeks to get some details of the driver which he told the police he didn't want me to have as he thought I would go round causing trouble. anyway the car he hit mine with wasn't his it was a family members but its his insurance we are dealing with.
anyway after ringing 3 different insurance companies I finally got this guys insurance company which took a statement and said they would get back to me after speaking with there policyholder.
after a few days they rang and said they had no contact from the policyholder and would send him a letter and would get back to me within 2 weeks not several weeks have passed with no contact so I rang them and when I finally got in contact with them I explained everything and also the fact I had been on hold 3.5 hours trying to speak with them which they wasn't bothered about. anyway they said he still hadn't reported the incident and would send out another letter and wait at least 28 days my reply was regardless of him reporting it the collision reference I supplied is enough proof that he is to blame and they should pay out there reply is we need our policy holder to report the incident before we pay out. now I asked if he doesn't reply ho do I stand there reply is until he reports it we cant pay out. my question is are they correct to refuse to pay for my damages and can they do this or is there anyway to make them pay by forcing them to pay out with 14/21 days etc. its been going on about 4 months now and I'm still no closer to getting my car sorted. any help would be gratefully received and I thank anyone that is able to guide me or help in anyway

Our car stationary car was hit by a lorry. We had photographs of the vehicles, the driver of the lorry and his mate.
The company concerned did not report the accident but fortunately, we had legal cover. They took over the claim and ended up taking the company to court for the money. The last we heard was that a summary warrant was issued against the company for the costs.
We didn't pay anything and our excess was paid to us through the legal cover.0 -
Do you know the name of the driver and ideally his address?
Which Insurer are you dealing with?
Is it the driver of the car's own Insurers
Or is it the Insurer of the vehicle that hit you0 -
If you have is address and name, you simply obtain 3 Quotes, get a proforma quote from the cheapest and invoice the bloke giving 7 days to reply.
Then if no reply issue a Letter before County Court action followed by a county court claim if he ignores the letter before action.
Let him worry about his insurance.I do Contracts, all day every day.0 -
I know the name and address of the driver and the drivers insurance company and policy number. I also have the owner of the cars name and address.0
