Can i claim on section 75

My wife and i flew from gambia to uk via barcarlona .Due to our first flight being 13hrs late we missed our connecting flight.My wife only has uk visa so is not allowed to land in spain.We had to spend 18 hours overnight in international area nowhere to sleep only wood benches or floor.Only help from airline some meal vouchers .Can i claim under section 75 because of bad service .

    Nope. I'm presuming you did get the flight in the end.

    You might be able to get something for the delays - there's a specific section on the forum for that so would be worth posting there.

    Indeed, a claim for the delay may be possible if the airline is an EU one.

    Feels a little irresponsible to book an indirect flight in such circumstances - there is always going to be a risk of delay, cancellation etc.

    I think that an S75 claim would be unlikely to succeed.
    This is because the airline was contracted to get you from A to B, and they did this.


    Also, what actual provable losses did you incur as you didn't spend any money on hotels and the airline gave food vouchers.


    What was the reason given for the delay?

    Normally you could have expected the airline to pay for a hotel room, but it wasn't their fault that your wife was not allowed to enter Spanish territory so unless there was a hotel within the airside part of Barcelona airport (which I'm pretty sure there isn't) there wasn't any more they could do. And because they did what they were able to I don't believe you would be successful in a S75 claim.

    File a claim against your wife for the issue as she didn't have a visa for Spain.
