What should I do

We moved out end of July and the LL still has not released our deposit and is kicking up a fuss about some not smoothed off polyfilla. The EA has offered to return us our deposit minus 250 which sounds a lot to make good some wall filling.

Should we
a) take whatever is offered now
b) insist on a smaller disputed amount
c) take them to court now.

I feel like doing c but will probably do b.

    You don't say how much deposit you are owed but option c would be costly. If you are considering court action, you need to weigh up the cost of taking the court action against the money in dispute. A solicitor's costs could far outweigh the £250 that it is proposed is deducted. So you could be worse off.

    Option B sounds a good idea, perhaps a letter to the estate agent to say that you dispute what they say and invite a smaller deduction. I obvioulsy don't know any background and so can't comment on how much it would be reasonable for them to deduct. It is a tricky situation because as it appears you are getting some of your deposit back minus £250 then if you start disputing then they may say well fine, you are not getting any of your deposit back so you will have to play it by ear. Nothing in this text replaces getting proper legal advice from a practising solicitor and you should not rely on what I have said - this is just my take/viewpoint on things. You could also perhaps try contacting your local citziens advice bureau.
