Vodafone failed repair attempts

I have a smart ultra 6, bought last july and has 12 months warranty.
Issue of 'phantom touch' when phone gets warm making it impossible to use.
Managed to convince them to send off for repair, came back a week later saying 'all fixed, phone updated', vague on what they did. It seemed ok, but phone still had issues (have to turn it off, then after an hours use it would start again)
Sent back a 2nd time, again vague on what they did. Still no real change (the phone needs to be on/used for about an hour to see the issue so doubt they actually did anything)
What are my rights now? Can I ask for a replacement, don't mind a reconditioned on, don't want to be having to send the phone off for repair every Friday until the warranty runs out. Cheers

Unfortunately, only the CRA that came into force in Oct limited the number of repairs the supplier can attempt.
The earlier SoGA didn't have a formal limit. If you ask for a replacement it's up to the supplier whether to replace, repair or refund.

Is there a number of times vodafone are allowed to attempt to repair? I could be sending it off every fortnight for the next 5 years (or rather until the day the warranty runs out), and at £3 a time to park in Derby it won't be worth it much longer. I've got a replacement phone as I can't be without, but I can see why soga has been replaced now, not fit for purpose ironically.0
