Social Services Overpayment totalling £3,300

it's a long story.

Social services (County Hall) where my appointee for 5 years. Managed by the Community Learning disability Team. I wanted the appointeeship Annulling so went through the long process of having a capacity assessment done which took 9 months in total. Passed the assessment and deemed to have capacity, County Hall then proceeded to deposit £6,600 in my account that I had saved up over the 5 years of appointeeship.

I rang my Social Worker and asked him if that was correct plus the supported living manager and they both rang County Hall and they told them it was correct, I went on a huge spending spree and spent the lot in 10 days - 14 days later County Hall said they had overpaid me £3,300, double the money and they want it back, I spend it all so they don't have much chance of that.

Now they want me to have the appointeeship back, I have no problem paying this money I owe but feel they did it on purpose to put me into debt and I've missed a few payments, they originally wanted £500 a month out my benefits but managed to get it down to £200 monthly payments.

They are threatening to send it to the debt collection people . I was wondering would this be court appointed bailiffs who can take my stuff, you know higher than civil bailiffs that you don't have to let in?

    If this happened very recently then why not return some of the items you purchased?

    This story does seem different to one posted two weeks ago?

    I haven't been managing my finances properly and approximately in £5000 of debt. Social services learning disability department wants me to have an appointee to look after my money and pay my debts off and they want to do an capacity assessment. If I fail it could that have other implications on things?

    Did your social worker/supported living manager appeal the overpayment? If they both asked County Hall and County Hall said it was correct then it may be an official mistake. Might be worth asking.

    I am not sure why you think the debt collector will come if you are making payments.

    Sorry, reread your post, you have missed a few payments. If you have to pay this back then ask your social worker to phone and have it deducted from your benefits at source. This will stop any debt collector action.
