Hi
I have letters from DRP which I am going to ignore.
But reading on, I shouldn't ignore the original PCN. I got this from Smart Parking, but I cant find my original letter to get this number to appeal etc.
How do I get this number again?
Thanks

How long ago was the parking incident? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hi
The date was 5/2/160 -
You can't appeal this late - you should not have ignored it in February - but never fear, it's only Smart Parking who CANNOT hold a keeper liable because they choose not to use the wording from the POFA Schedule 4 on their postal PCNs.
As long as no-one contacts either party saying who was driving then the keeper is not liable in any way in law. What would be interesting and worth a complaint to the DVLA, would be if the DRP letters are mentioning the POFA 2012 and alleging that the keeper is liable for this charge.
What happened when you complained to Asda Head Office or whoever owns the retail car park? Smart do not own it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi
I haven't been in contact with anybody, Asda, Smart parking or DRP.
I was going to appeal the PCN after reading advice on here, but have misplaced my letter with the PCN number from Smart parking. I'll continue ignoring any further correspondence.
The letter does have that POFA 2012 element on it too. I assume the DVLA take a dim view of said wording?
Thanks0 -

Why? to the sentence in bold Pappa Golf?
That was in response to what Coupon Mad said about them.

if it was ANPR how many days after the incident did you receive it

So DRPlus have alleged keeper liability under the POFA, arising from a Smart Pakring NTK which categorically is never a POFA worded version?
I would email the DVLA with a copy of the NTK (BOTH sides) and a copy of the DRPlus letter and complain that DRPlus have misled you about keeper liablity regarding a PCN which doesn't even attempt to have the paragraph 9 of Schedule 4 wording.
DRPlus can't say a keeper is liable when Smart didn't establish keeper liability with anything lie a compliant notice.

Do not add anything at the start or anywhere talking about who parked, OBVIOUSLY! This is a complaint from the 'keeper' about DRPlus misleading you about your liability as keeper.
