KILLSTAR - no refund, just 'online credit'

Can anyone help with my consumer rights
I have purchased and returned a top which did not fit from the KILLSTAR clothing site.
I returned as was not suitable, and they have refunded me with an online store credit.
When i queried it, they said they did not refund on sale/flash sale items, only gave credit.
Is this acceptable. Of course, I did not even read the small as I had no reason to assume they would not refund if the item was not suitable...
had I seen the samll print before, I would not have orderded.
would hate to have to read small print on everything before shopping online.
would be grateful if anyone could emlighten me on the 'distance selling' regulations and whether I have any rights to challenge their T&Cs and get a refund. thank you everyone:)

I can see the term "Sale items or items purchased during flash sales will be given store-credit." in their Exchanges & Returns page.
If you have notified them of your wish to cancel the order within 14 days of delivering the order, they must refund all monies paid.
There are a couple of exceptions though.
1) if you paid for a speedier delivery service they only have to refund the basic delivery cost.
2) if you are only returning part of an order then you cannot expect any of the delivery cost to be returned.
3) unless they stated that you must pay the return costs, then that cost is down to them too.
There may be others.
Have a read of MSE's Consumer Rights guide for more detail.
There is a section specifically on buying at a distance.
And no, store credit is not a refund.
Their terms cannot overrule your statutory rights.0 -

Governing Law and Jurisdiction These terms and conditions are to be construed in accordance with the laws of Scotland and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Scottish courts.0 -
