Santander vs Fusionx212

Hi All, thought i'd swing by with some goods news.

I raised a complaint to santander using the Resolver service on the basis I had not received any correspondences about defaults and arrears on my account.

back story being lots of running around after santander to prove my accounts, being told new day was responsible now it was h samuel now it was santander. just so I could even get my account information.

so I got a call today from santander who said they have no proof of the default ever being sent to me and don't have a copy of the letter.
So we agreed the default needs to be removed from my credit record as they have made a mistake.
they said they cannot remove any arrears information as this is a correct look at my credit history, but I was questioning saying if I did not recieve the default letter and you don't have a copy of this how can you leave the arrears on my credit report. she said they cannot remove them.

hmm So I ask if they have a copy of my credit agreement and do i have any ppi on the account they said - No ppi fine, they offered me £250 compensation and to remove the default.

I've accepted £250 for effort and damage done to my credit report for all these years.

However I think I have a case for my arrears to be removed also.the fact they didn't have my default letter scanned by the previous letters showed.

I see this as failed reporting does anyone see my point here. before this also I complained to experian saying the information was incorrect and santander said it was all correct etc I may just raise a letter complaining about it to the FOS and see.

the arrears do get removed in january 2018

    A blatant bare-faced lie. Scammers such as Santander have unfettered access to data about you held at the CRAs. They can amend it any way they think fit. This business of "it's a truthful representation of your account ..." (example quote) is total baloney.

    kinda what I know bob. I'm gonna go to the FOS and challenge it as they admitted fault by not sending the default.

    meaning the rest of the statement information is incorrect for all I know.

    It's not on me to prove I owe the money, it's on them and they havent proved it.

    I asked for a copy of the cca also.

    Did you borrow the money, and fail to pay it back in a timely manner?


    That's all the credit history would show.

    I did have an account. To the best of my knowledge I paid it all off.
    I didnt know about the default.

    There is clearly a discrepancy in the payments they say you made, and the payments you think you made.

    Have you asked them for a statement of your account, showing the payments which were credited? You can then compare this to the payments you sent to them.

    Do you have evidence that you made each of the payments, in full and on time?

    more than likely not.. for this account it account was from 2007.
    default marked on 2011. they didn't seem to have to much information about me I asked for a copy of the documents for me to review.

    I am confident I can argue this with the fos though

    I may just take it as a small success and a default has gone from my report and wait out the late payments from nearly 6 years ago.
