HELP Help can I cancel my order???

So today I ordered a suite from SCS for £2282 when I was talked through the credit agreement I asked about a cooling off period and was told that I had 14 days to cancel my finance agreement but would have to cancel my order separately with the store, I was talked through the finance agreement Terms and conditions but not the t and c's of SCS. I signed for the credit agreement and was sent to collect my 'receipt' from the customer service desk. On the way home I received a call to say that I had left without signing some additional paperwork and could I return later in the week to sign them. We have decided that we no longer want the suite as it's too much of Financial burden at present but have checked the paper 'receipt' I Was given and notice it said cancellations are not accepted. The receipt is actually the 'customer sales document ' which details the order and I didn't receive this until after I had arranged the finance and this is unsigned. I presume this is what they want me to come back for.
My question is can I legally cancel this order? I was not told there was no cooling off period and, I asked twice If there was, also I didn't receive any information about Scs terms and conditions until after I'd signed the fiance agreement. I have been emailed these t and c's I'm going to call them tomorrow but want to be armed with the correct information. Can anyone help PLEASE???

    Did you order in the shop? There isn't usually a cooling off period for an order placed instore because you've seen the goods and you know what you're getting.

    Have you paid any money? A deposit perhaps?
    If so, that would be a further indication of your commitment to buy.

    Anyway, it strikes me that you have agreed to make this purchase, whether or not you have actually signed anything.

    Yes of course you can break the contract. You may well be liable for any losses.

    You really should always consider all instore sales to be final unless told otherwise. There is no statutory right to cancel an instore sale.
  • No I didn't pay any deposit and although at the time I didn't intend to cancel I was led to believe there wad a cooling off period as the sales rep specifically said there would need to be a cancellation of the finance agreement and the furniture order separately I guess I just feel now quite concerned that I didn't get anything to say I couldn't cancel until the end.

    The credit agreement and the order are 2 separate things, whilst you do have 14 days to cancel the credit agreement you are still liable to complete and pay for the order.

    I'd ring them straight away and see what they can do for you.

    As said above you can cancel the finance agreement as it is inside the cooling off period.

    You can also cancel the order but I believe the supplier would be within their rights to recover their provable losses. It is unlikely that they have actually started cutting wood and fabric so their losses would be small. You MIGHT be allowed to cancel as a gesture of goodwill or in payment of a small admin fee. It is up to the store. Don't delay ring today! Good luck

    The problem is that you have interpreted the sales person's statement as providing you with the ability to cancel the furniture order, whereas what they really meant is that you can only get out of paying for the furniture if the store allows you to cancel, which they are under no obligation to do.
