paving above neighbour damp course

HI all, Please can someone advice.

My paving (detached house) of my side passage was done above the damp course of my neighbour. we are on top of the hill. Completely our fault. So we rectified the situation by removing the line of blocks closer to the neighbours wall, and digging a trench. the trench was dug at least half a meter below their damp course. in doing so The water will runs down the side of the passage to my garden (also on a gradient).

now my neighbour is disputing that i should've put a damp course membrane next to their wall and run the membrane under their rendering to complete a damp course.
is that right?

and what was I suppose to do?
