Argos Failed Delivery.

Hello All,
I recently ordered a new mattress from Argos on 28th April for next day delivery at a premium of £19.99, on the morning of delivery i received an email and text message saying that my new mattress will be delivered between 7am and 12pm.
I then took my existing mattress to the local recycling center, 12pm comes and still no mattress, and no phone call so i rang up Argos customer services who told me that it was still out for delivery, another couple of hours passed and still no mattress, but now on the tracking it is marked as delivered. Customer adviser tells me that the load has had to be split as it was too heavy so could be delivered up until 9pm. To cut a long story short i have had to sleep on an awful inflatable bed, as i suffer from MS this is not ideal. After numerous phone calls the earliest they can get the mattress to me is Saturday (8 days after the agreed date). My wife is distraught, i am in pain from sleeping on a blow up bed.
Does anyone have any advice on my rights or potential compensation for this?

    You are entitled to the money you paid for next day delivery back.

    That's about it.

    If this was going to affect you so badly, leaving your wife distraught over a mattress and you in pain, the sensible thing would have been to not have disposed of your mattress before you got the new one. Things happen outside of your control (the lorry could have crashed, burst into flames, all manner of things) you acted too soon.

    So you took your mattress to the tip before 7am after getting a message saying the new one would be delivered??? What time did they send the message??

    You are entitled to a refund of the £19.99, and read the sticky post about missed deliveries e.g. If you incurred any expenses by waiting in.

    I'm afraid disposing of old mattress before new one arrived was brave/foolish.

    If you are in pain then I suggest cancelling Argos order, and ordering from somewhere else who can deliver ASAP.

    The mattress went to the tip at around 10am.
    Argos are now saying that the ordered item is not in stock so they cannot deliver till at least Saturday, but they allowed me to order for next day delivery and confirmed it will be delivered on the 29th.

    Nobody's disputing this. You can do two things, ask for a refund of the £19.99 next day delivery charge and wait until it is delivered at the weekend, or cancel the order altogether and get a mattress from somewhere else. It's no ones fault but your own for disposing of your old mattress before you'd received your new one.

    But today is Sunday and it's May 1st, I think you need to confirm the dates that you're talking about.

    I think the dates are clear in OP post.


    i.e. ordered 28th for 29th next day delivery cannot deliver until sat 8 days later as stated in post.


    What dates do you need confirming?

    I misinterpreted the comments in post #4 to mean that Argos are now (as in on May 1st) saying that delivery will be on the 29th, when in fact now meant on the 28th.

    My argument with them would be that if it was out for delivery on Saturday what has happened to it? Have they lost it, misdelivered it, had it eaten by a mutant star goat? Or were they just lying in the first place?
