credit report help !!

Hi all and thanks for taking the time to read my post. This is my first post here so sorry if my question has been replied to before. Okay so heres my problem... I recently decided to take a loan out but was declined by the lender so i signed up to noodle to check my credit file to see why. After checking my file i seen there was a default put on from lowell in 2009. The only thing i can think of to why i have this is due to a mobile phone upgrade i had years ago. i took my phone contract out with carphone warehouse in 2008 and when i was due an upgrade i went into store and upgraded my mobile phone but to a new network this time.... vodaphone (but contract was through carphonewarehouse) who i have been with since and not defaulted once. obvioulsy because i upgraded my phone in store i automatically thought my new contract would carry over but this was not the case as i would find out two years down the line. i recently moved address after changing my contract and 2 years down the line received contact from a debt collectors calming i owe them a £270 phone bill from orange. my question is, how can this be? i was not using the phone or contract at the time because i had upgraded and even if i did how can the bill be so high? the phone would of been disconnected 1 month into not paying? now i am stuck with a default on my credit history which i am desperate to remove as i have a clean report apart from this. do i contact orange and ask for proof as to why i have this debt and do they have to prove i owe them this money before they can pursue me ? or do i contact the agency who defaulted me.... lowell and ask for proof of why i owe this money? Any help would be very much appreciated. thanks again

    Unless you have a particular need for credit I'd be tempted to leave be, as it will drop off after 6 years (so some point this year). You don't mention the month but it might fall off as quick by itself than by complaining

    Also small point, but could you use the carriage return key to break up long sections of text, much easier to read, which means more people will read and offer help.

    the date was from 28/12/2009 but a ccj has also been added 12/11/2015 so i am desperate to remove this.

    if i write a letter to the company do they have to provide proof of why i owe this debt? what is my best option here?

    Sounds like you took out a new contract with vodafone, and the one from orange kept running. Probably worth getting into contact with orange and carphone warehouse

    One of your comments says that you think orange should have cancelled after one months non payment. Unfortunately if you didn't cancel the contract they have the right to charge you indefinitely as you would have agreed to in the contract

    It may well be that orange\lowell are technically in the right, while they could remove the default, i'm not sure if they can the CCJ. I'm assuming you never got the CCJ paperwork, if so i'd look more into this (as you can't defend a CCJ you don't know about)

    would not contacting orange (do they exist?) restart the 6 yr , or is that just for defaults?


    the fee for a set aside is now £255 , (gone up from £155) , but even then you would have to prove you owe them nothing , you admit you let CPW do the paperwork but did not cancel or check yourself.




    I wold be kicking off with CPW !

  • I didn't receive any paper work in the post and have not had contact with anyone about this tho. Like I said the only way I know about this now is because I signed up too noodle, I had o idea who Lowell where before yesterday.

    I have sent an email to Lowell requesting more information on this and proof as to why I owe money to orange in the first place. Do they have to supplied this by law? if not any firm could claim I owe them money surely ?

    I'm going to seek help from my local citizens advice as I'm totally in the dark with this and am desperate to get my name cleared.
