Based on what you have said I would go for the extra points.

Write down the descriptors you disagree with and back it up with the evidence (noted by HP and other medical evidence.

Just the wearing a hearing aid by itself should get two points.

scroll down to page 107 for communication.

The only thing I would check before going for MR/appeal are the points already given for both Daily Living and Mobility as they may look at the whole award again. Just be certain that points already awarded are irrefutable.

You can use the link for the other points you raise as well.

I'm confused. Surely if you wear a hearing aid so you can hear better, which then helps you communicate better, then you're already in receipt of the need you require?

My MIL has just got one. We didn't think she had a problem, asking a few times for us to repeat ourselves but still able to communicate well, but she says that she can't believe what difference it makes to her and now feels like she's 20 again (from the perspective of communication!).

I just don't understand why wearing an aid that means it puts you in the same situation than if you didn't have a hearing problem should justify in itself points in relation to communication.

The MR should be sent to the address at the top of the PIP decision letter.

I know what you mean. For most people, surely wearing a hearing aid means that they need less help with communication. My son wears aids, but cannot put them in himself, cannot adjust the buttons accordingly, and cannot change the batteries. In his case, I can see why he would receive points for needing help to wear them (although he is likely, when he is invited to receive PIP, to get more points as he has severe speech difficulties, short term auditory memory, social anxiety with strangers, and learning difficulties, all of which affect his communication. He also signs to a small extent, uses a printed keyboard aid, and writes things down when nobody can understand him).

Ive just sent off my MR too. The nurse that assessed me told outright lies. Thanks to her I am now losing my mobility vehicle and I am going to be house bound.

    Good luck with yours.

Is it a heavily adapted vehicle? If not the £2k you get from motability should get you something to replace it, even if it's not ideal, while you go through the appeal process. Or pay for lots of taxis.

(That's unless you're a new motability customer, in which case it could be £1k or nothing).
Unless I say otherwise 'you' means the general you not you specifically.

Don't expect miracles from MRs, start to prep your appeals. For my MR the decision maker didn't even read the letter I wrote and just rubber stamped the previous decision. The DWP didn't admit this until I pointed out that when the new decision was made my letter was still in the post.

Definitely not worth challenging at appeal (not sure if the decision was revised at MR or tribunal) as your relative has the top award.

But by all means write to your MP with your concerns if you wish.

    NO.

    Leave it.

Your relative cannot be awarded anything more.
By challenging you risk the possibility that the award will be reduced. This does happen.
Save your energy for the renewal in a few years time.
