Alleged debt

Options
Hello All,

I have just had a call from a debt collection agency who claim I have a debt with Sky (despite being with Sky now) from an address I was at several years ago.

The lady confirmed what the owing balance is as well as saying the contract started on 27th February 2010 and said my last payment was made on 29th May 2010 - does that mean that from 30th May 2016 it is statute barred?

Any other advice would be great.

Thanks,

I thought as much! And she has put the account on hold for 30 days! I still don't believe it is my debt but will play their game!

    Hi Yoshiyella,

The start of the 6 year clock under the limitations act begins from the date of cause of action. This is either from when the last payment or written acknowledgement was made or from when the first payment was due and missed - whichever is the later.

At the moment the information that you have from the debt collector is only over the phone and nothing is confirmed, but if we take the information as correct for a moment and the last payment was made on the 29th May 2010 but a payment was due on the 29th June 2010 and missed then the date of cause of action would be the 30th June 2010. Have you had anything off them in writing so far? They would really need to write to you in order to do anything.
