Parking charge notice - PCN

Hi,
I've recently received a parking charge notice from PCN admin centre for Two Saints car park in Ormskirk. I have looked into this on the MSE forums but can't find circumstances quite like this one.

Basically, there is one hour free parking after which you are expected to pay. As we were in the car park for approx. 2 hours we were prepared to pay but due to the queue at the machine and an unwell child, we read the terms and conditions on the sign which stated that we could pay online within 24 hours. When we got home, within 1-2 hours we went online to pay but were rejected on three separate visa debit cards, all of which had sufficient funds.

We emailed the address on the sign explaining what had happened but received no reply. We also tried calling the number but got no answer as it was a sunday. We then received a PCN through the mail which we've appealed against.We then received an email from zzps stating the time frame for appealing has lapsed and the PCN would be pursued. We have since received an email from zzps with an attachment stating the appeal had been rejected on the grounds of no payment made.

I am willing to make an appeal through POPLA but not sure if it'll get me anywhere. We were upfront with wanting to pay the charge and tried following the guidance on the sign but were unable to pay online and calls and emails were unanswered.

Is there anything I can do about this or should I just ignore the letters?
Any advise on this matter would be greatly appreciated.

    did they give you a popla number?

    if so , check its expiry date on parking cowboys website

    then draft a popla appeal and post here for critique , making sure it is submitted as a pdf in time

    only a fool would ignore it, and I trust you are not one ;)

    You need to put some paragraphs in your post, many (of the few) regulars will skip this as it's just too difficult to read as a wall of text.

    There are numerous threads about Two Saints Ormskirk - just put those words into the forum search, change the default 'Show Threads' to 'Show Posts' and see what that brings.

    If you mean by 'can't find circumstances quite like this one' is related to you having to queue and having an unwell child, it makes absolutely no odds.

    100% of cases are all the same - a scammer is after your money and your circumstances on the day are wholly irrelevant to the parking companies. This must be tackled on legal and technical issues, not mitigation.

    I agree

    I found it almost impossible to read it but got the gist and saw the important info was missing , so I concentrated on those aspects and I gave up on the rest

    too many people dont use the NEW LINE - NEW PARAGRAPH button and then when those of us with a form of dyslexia complain we are treated as if we are nitpicking , we arent nitpicking

    as you can see from this reply , its easier to read and pick out the details, so please edit post #1 and add some paragraphs

    What I meant was that most posts relate to staying beyond the free time or paid for time and not being willing to pay the PCN. In this instance, I was more than happy to pay the car park fee, it was just not possible on the website.

    We now have a popla code. I will look into the template letters on parking cowboys website, thanks

    Barry Beavis stayed beyond the free time and went to 3 courts for his trouble (and lost in all 3)

    he could not pay for extended time however

    but as what happened on the day rarely features in appeals, we tend to ignore most of it, plus I could not read what you had written anyway, but I did notice what you missed ;)

    I never told you to look at template letters , I told you to check its expiry date, nothing more , so you are now going "off piste"

    there are no template letters for popla appeals, each one is bespoke

    so you need to find recent 2016 examples ON HERE of popla appeals and choose the relevant points to draft your own bespoke appeal

    The problem with my appeal is that I cannot find anyone with a similar issue to my one i.e. trying to pay online but being unable to. I will search for popla letters on MSE forums to see what I can come up with.

    you seem to think your appeal will be based on a similar circumstance to yours , ie:- mitigation

    well it wont, which is why you find nothing , it does not exist

    your appeal will be based on half a dozen legal arguments, same as all the rest

    which are

    no landowner authority
    POFA2012 (if relevant)
    NTK flaws
    BPA CoP breaches
    poor or incorrect signage (fails the BPA CoP)
    How your case differs from the Beavis decision

    check what is currently winning popla appeals in the POPLA DECISIONS sticky thread , working back from the end

    use the forum search box and search words to find and read recent 2016 popla appeals drafted by other members and eventually approved for submission

    ps:- post #1 is still a wall of text to me, no white space between paragraphs
