Details for responsibility of boundaries

I hope someone can help please....

I have spoken with my next door neighbour over the weekend as we have both recently moved into our properties and we were discussing boundaries. I showed them the title deeds that I had which has a red ring drawn around our property but nothing more in depth than that, our neighbours have said that their deeds were more detailed giving details of who is responsible for which border etc.

Is there some way of getting more details plans from or is it likely my neighbour has the same as me?

I have popped a call into my solicitor but they say there is nothing more detailed on the file other than what I have

    Dig out the full title document that your solicitor should have given you during your recent purchase, the one with all the covenants/rights/etc. Not just the basic document with the names and charges on it.
    It will likely detail boundary responsibilities, even if it is just to refer to 'T' marks on the red-edged map.
    Do you disagree with your neighbour?

    I still have access to my online conveyancing file and I can see they have uploaded a title plan and title information. The title plan is the document as mentioned above, no details with "T" as to where boundaries lie, just red circle round whole property.

    The title information is about five pages long, it tells me about charges, tells me I have the right to use sewers/pipes/electricity etc but nothing relating to boundaries

    I don't dispute what my neighbour is saying (I haven't seen their title deeds) but would like to see mine for myself as I am thinking of replacing the fence that doesn't adjoin my property to theirs, so would like to know for sure if this is mine or my other neighbours responsibility before speaking with them. Also, my property backs onto a canal so I'd like to see if it gives anything more detailed as to where my land lies there and where the waterways own.

    If there are no T marks then it could mean either that none of those boundaries are your sole responsibility or all of them are shared responsibility. If your title says nothing about sharing, one explanation is that all the boundaries are your neighbours' responsibilities.
    Do your neighbour's document agree with that theory?

    The red-edged map will tell you where you land ends and where the Waterways' land starts.

    My current house's map has no T marks but the documents expressly details sharing. My new house's map has some T marks but not on all sides, and we take it to mean that the unmarked side is "owned" by that neighbour.

    I haven't seen my neighbours documents, but as I have access to my documents on my phone I was able to show them mine which is when they told me theirs were more detailed.

    How old is your house? If not a new build there may be an earlier transfer on the Land Registry records. This will have a plan attached with the "T" marks. The standard issue land registry plan downloaded at the start of the transaction never has them on.

    It was built early 80's, I'm the third owner.

    Do you know if I should have been issued with these or is it something I'd be expected to pay for from the Land Registry as what I have should suffice for the purpose of buying/selling?

    Send me a private message if you like with the title number, I'll have a quick look when I'm at work tomorrow and can tell you if there is a transfer document available :) Alternatively you can always register with the Land Registry and search yourself. You won't be charged for a document (£3) unless you actually click that you wish to purchase it (of course you won't be able to see more than the document name and date it was registered unless you do purchase it though !)

    I had to pay Land Registry £3 for the title and then another £7 for a copy of the "conveyance" when the house was sold by the council to the old owner. This £7 copy had very detailed plans with measurements.
    I did the same thing for my house and both houses next door, just so I can see what my neighbours think they own too :)
