hi all, im just fishing for some information really.
I am currently having an overpayment from 2010 taken back at £80 per week! a massive amount and the tax credit office now want me to send them tons of information so they can scrutinise my spending so it can be lowered to a far more reasonable amount.
the thing that really bugs me is that I disputed the overpayment, due to the fact I was ill and did not receive sick pay, as well as me having sick days my boys also had sick days which meant I had to take unpaid time off work thus leaving me on average having worked 15 hours a week on average instead of 16.
they are claiming back £9000 (apparently ive already been paying some of it off?) even though I sent them proof of paying £11000 in childcare.
I am looking to dispute this and I have found the whole process rather sneaky as I have no paperwork saying that there taking it back and I was also told that they couldn't take it from my joint claim as it was occurred on a single claim?
anyone know what form to fill out and has anyone actually ever won against them?

I'm afraid the disputes, or is it appeals, system is byzantine and rigged in their favour in that they can dream up overpayments from year dot but you've got a month or 3 at most to appeal. Historical cases like yours are manna from heaven to them as you're automatically timed out from any appeal. You could always go nuclear and contact your MP.0

What happened when you disputed the first time?
It sounds like yours possibly should have been an appeal rather than a dispute if it was about the averaging of hours.
Perhaps you should speak to an adviser who knows tax credits who can look at whether the decision was correct (based on tax credit rules) and whether there is any scope for a dispute/appeal now (unlikely due to time limits but depends on earlier correspondence)
If you disputed it previously, presumably you knew about the overpayment. It will have been notified to you on your final award notice for the relevant year.
Do you know the reason why you didn't receive sick pay?
