Updating credit file.

Hopefully a simple question.

When a CCJ has been settled are the company you have made payment to under any obligation to update your credit file to show the debt as settled.

Also same question regards incorrect information entred,ive proven to a company they have incorrectly updated my credit file..shown them the proof and they are being awkward,they say they have no obligation to change the incorrect information.

If i want it changed its up to me to contact the various credit files with proof...that would be the same proof i have already supplied to said company.

    With a CCJ you have to show the court that it's been satisfied, then they update the record on the registry trust which then updates the CRAs.

    A default on the account is a separate entry, and it is the creditor's legal responsibility to ensure that is updated. If they are refusing to mark that as satisfied, then make a formal complaint stating that they are in breach of their duty under the Data Protection Act 1998, and unless they correct you will be taking them to their ombudsman and reporting to the ICO.

    Regards the Default.

    So for arguments sake the debt was included in Bankruptcy some years back...proof of which they have been given (multiple times) and they refuse to update the credit file and then pass onto a Debt collector to chase debt (Debt collector now stopped).

    Contacted the Offical reciever and he said the firm was under no legal obligation to update credit file,but couldnt chase debt...he seemed to think it was my job to raise a complaint with firm,bit pointless when i have and they refuse to update...seemed odd advice.:(

    The creditor does have a legal obligation to update.

    Most people at a creditors you speak to on the phone are clueless on how credit files should be updated, or will tell you blind fibs.

    The law and guidance from the ICO is clear though.

    If they refuse, then you take it to the FOS/ICO.

    Sadly too many creditors refuse, which is why that clean-up thread exists...

    They are under staffed and under trained, and knowing how credit files should be updated is none of their responsibility, so something that that probably just passes many examiners by.
