Ignored PCN fine now have County Court Claim!!!

    You can't take the rap.

    This is a claim (just a civil allegation, possibly - but not definitely - leading to a hearing like in Judge Rinder's court, in a way) against your DAD not you. It is too late to name the driver but the fact he ewasn't driving gives your Dad more of a defence because the PPC has to prove complaince with the POFA 2012 Schedule 4, to hold a registered keeper liable.

    Your Dad can defend this and it is defendable.

    Have you not yet searched the forum for all the zillions of other court claims on this forum? The amount of exclamation marks in your heading suggests you think this is unheard of. No, we help people defend these every day.

    First thing is to acknowledge the claim to extend the time to respond with a defence to 28 days from the date of service of the court papers. So read gthe paperwork to see how to acknowledge. If it's a claim from the Northampton central court centre than it's issued online and your DAD (NOT YOU!) just needs to register and log in and acknowledge the claim saying he intends to defend the claim in full.

    He leaves the defence box completely blank, not even 'TBA' in it, nothing at all in the defence box when acknowledging.

    Then, search this forum for 'court claim defence POFA' or 'statement of truth'.

    Either of those keyword searches will show you examples of how a defence looks. Find one which includes mention of the POFA 2012 and 'no keeper liability'. Use those other threads to copy from, to cobble together a defence for your Dad within the 28 days (as long as you acknowledge first!) and show us for comments.

    I've had a look around the site and on the sticky thread but can't seem to find much on responding to a County Court Claim (for someone who has ignored all correspondence from the PCN up until now)

    I'll upload the photos soon when I have them - thanks!

    plenty of stuff there to read, including bargepoles dummies guide, plus read the parking pranksters book too

    as for this court claim, its not against you, its against your dad, so only your dad can deal with it, (or you deal with some of it but on his behalf)

    they will try to make him as RK take the rap, not you , if they have followed POFA2012

    also use the forum search box and words like COURT CLAIM and read ll the recent 2016 court claim threads about UKPC and CEL , they should help you too

    do not look at older threads from before November 2015

    as for your posts like post #1, its worth noting that

    you have not ignored the letters, your dad has

    you have not received a court claim , your dad has

    you do now acknowldge it online , your dad does

    you do not defend the court claim , your dad does


    see the pattern there ? (nothing to do with you)
