Speak/write to the OR and/or the HMRC and tell them to stop.
As long as the overpayment was an error on their part and not due to fraud or a misrepresentation on your part then they should stop.:footie:Regular savers earn 6% interest (HSBC, First Direct, M&S)
Loans cost 2.9% per year (Nationwide) = FREE money.

Hi Gareth
Saw your post on another thread and didn't realise you'd posted here too.
If your DRO was arranged through us, we have a letter template you can use for creditors still chasing debts after your DRO is approved - other intermediaries will probably have their own versions. You may want to enclose a copy of your DRO application clearly showing their name in your schedule of creditors, just for avoidance of doubt.

The overpayment does not have to be an error it is a genuine overpayment just like all the other debts in a dro, but they are all written off in a dro.0 -
This is for bankruptcy, but same advice from debt doctor et al applies.

So I rang them up and been through it all, they agreed the debt was included in the dro, but it's still being taken out of my child tax credits0

Hi,
Thanks for the PM Fermi.
You will rarely get anywhere with HMRC or the DWP in sorting out problems unless you make a formal complaint in writing AND follow the correct process.
This is the process for HMRC tax credit complaints that you need to follow:
https://www.gov.uk/tax-credits-appeals-complaints/complaints
Do everything in writing. If you do not get an acceptable response or no response within a reasonable time - say 14 days, then move on to the next stage.
Use recorded delivery.
