car damaged in carwash

Hi Peeps
my car got damaged in a drive through car wash IMO ARC to the sum of £1500. I filled in an accident report form and waited for replay, after a couple of weeks i received an email asking for detailed photographs. I sent along with quote for repair. I received a prompt replay saying they are only landlords and they can ensure me their equipment was in perfect working order on the day of the incident and they are referring it back to the tenant. :mad: tried to replay to this letter only to get fobbed off saying the case has nothing to do with them anymore ?? and wouldn't answer any of my questions.
I cant see me getting anywhere with this company.
What can i do to get this resolved ?
Ombudsman, small claims court ??

    The IMO near me has a damage waiver sign as you drive in.

    In fact all automatic washes I have used have displayed one.

    Did the CarWash damage the car before yours and the one after yours?

    Or did it just cause damage to part of the bodywork that was already loose or previously bodged?

    Don't think an ombudsman can deal with this (unless they're a member of one). Do you have a legal helpline with your home insurance that you can ask for advice? Alternatively you could contact citizens advice:

    Ultimately it may be necessary to file a small claims case against both the tenant and the landlord (i.e. any party that you think may have responsibility) but you'd need to seek advice to ensure this is done properly.

    i cant say i have ever seen one unless its that small you cant read it unless your stood in front of it.
    dont know if it damaged the car before or after i was the only one there at the time.
    damaged is to my roof hope it wasn't loose and no its not a convertible.
    i had roof bars on and the bars got caught up. wasn't until i reported the incident the operator said he was not supposed to let cars through with roof racks.

    I was with you until I read this point - your fault and nothing you're likely to get out of anyone as compensation


    Same level of common sense needed here as putting down/removing radio aerial and keeping windows closed :rotfl:
