Next and Cabot

Hi All,

a couple of years back - i had a next account and i defaulted on it.

It came on my credit file and dropped after the 6yrs period had elapsed.

recently cabot seem to have bought the account and are now chasing again.

is cabot able to put this back on my credit file or take me to court?

    If the account has dropped of your report due to the recorded default being more than 6 years old, then no, Cabot are NOT allowed to put it back on.

    That's not to say that some debt collectors don't break the rules anyway and do so, but if they should you can complain to have it removed, taking the matter to the FOS/ICO etc if required.

    You say you defaulted on the card 'a couple of years back' and then it dropped off after 6?

    Is the default actually more than 6 years old?

    Or is it 2 years old and just disappeared?

    the default is more than 6yrs old - default was about 2008.

    @Fermi - thanks - i get mails from cabot - do i respond?

    this morning i got a statement of account from them - seems they bought the account in 2010.

    i have not responded to any mails from them - 1) i work out of town so only back home once a month
    2) am not sure how to progress

    i have a cci on my credit already and i know how hard / complicated it has made issues - i do not want any other hiccups from this at all.

    You won't get any hiccups, it's past the 6 year limit and they are trying to get something out of you.
