Blue Badge Appeal Refused

Hi, l have a valid blue badge and l parked at Asda blue badge car park in Manchester and forgot to display my blue bade when l went to pick my prescription. Upon my return to the car, l was issued with a ticket by vehicle control services for £60.00 fine. l sent an appeal simply stating that l was in a rush and forgot to display my blue badge. l attached the front and back copy of my valid blue badge together with the appeal letter. Received a response yesterday rejecting my appeal on grounds of own admission of 'l forgot to display the badge' and that no further appeals will be accepted. Vehicle Control Services letter stated that issuing of ticket was correct and notice will stand. However at the back of the letter it says that l am entitled to appeal to Independent Appeals Services within 21 days. It was a genuine mistake however it appears the decision is harsh as l am a blue badge holder. Vehicle Control Services also said that if my appeal is unsuccessful the discount will no longer be offered and a full amount of £100 will be pursued. As l result my blue badge is now permanently fixed to my dashboard in case l forgot again. Please can you kindly advise what action to take.

    Your first job is to carefully read the NEWBIES thread on the front page of this forum, there, you will see all about what to do and from that you can ask for further advice.

    Vehicle Control Services are one of the scammers that patrol car parks, the IAS (Independent Appeals Services) ARE FURTHER scammers who favour their members and not the motorists.
    You can of course appeal but chances are slim

    ASDA
    For some reason only known to the CEO of Asda, they appear to approve these scammers and ignore their customers.
    Whilst you can contact Asda to complain, at the moment do not hold your breath.

    The answer is to simply STOP SHOPPING AT ASDA and tell all your friends the same.

    VCS dont normally patrol ASDA car parks, it was Smart Parking but they have lost the contract at the end of this month

    so maybe its a retail park patrolled by VCS ?

    in any case, the BB isnt valid on private land , although they use it for these purposes , but if you read your blue booklet you will find it does not cover private property , which includes hospitals, car parks , retail parks , doctors surgeries , supermarkets , airports and railway stations etc

    The EA2010 covers you in these cases , so the landowner and VCS are jointly liable under the EA2010 and so VCS should have cancelled

    complain to the landowner and cite the EA2010 and consider a counter claim , because the EA2010 is what gives you the right to park there if those spaces are available and are signed correctly because there has to be the offer and spaces have to be provided by law, the EA2010 does not indicate what method of proof has to be shown, but VCS should have cancelled once the proof was offered

    do not assume your BB gives you carte blanche on any space with the disabled logo, it doesnt , some people qualify under the EA2010 for the parking yet not for the BB , so its discrimination and the EA2010 is a law that trumps their rules

    Ours always has been, stuck on with velcro.

    As above really, what happened when you complained to the Retail Head office or probably the Landowner, seeing as Asda don't use VCS themselves (must be a multi retail park)?

    Hope you realise you will get hysterical letters about this for months and months, but DO NOT PAY. You have not committed any crime nor do you owe that firm any money. But get it quashed by turning to the retailers/landowner (Google the name of the place to find who runs it).

    The IAS in this case is not worth even trying; a kangaroo court.

    Thank you all for your comments and advise, the parking charge notice was issued by VCS. Yes it is multi retail retail park. North City multi retail, in Manchester. l will look up the EA2010, which part or schedule should l look at and use.

    Your chances of being taken to court are slim, but you chances of being hassled by the PPC, debt collectors, and perhaps even dodgy solicitors are high.

    Write to all the retail outlets on the park complaining that the PPC are failing to make provisions for BB holders as set out in the Equality Act. Also, write to the landowners and your local paper.

    Also, appeal to the IAS, you will lose, but it will cost the PPC money, and the unsigned rejection of your appeal could be used in court against the PPC.
    You never know how far you can go until you go too far.
