Welcome Finance / Direct Car Finance

Hi all,

I've got an interesting situation that I'd like some help or advice on.

I made a claim to Welcome Finance for PPI on a hire purchase agreement for a car, agreement dated 24 July 2002.

Welcome's reply: "The PPI associated with this account was sold to you by a broker and not by Welcome Finance. This being the case, unfortunately, any complaint pertaining to the sale of this policy must be referred to Direct Car Finance Ltd now trading as ACF Care Finance Ltd, for it to be considered."

I wrote to ACF at the address on Welcome's letter to be told that ACF Car Finance Limited was incorporated on 8 May 2003 (company number 4757280) and they suspect my claim is against Zepaoloane Limited (company number 2920411) which changed its name from Direct Car Finance Limited on 22 January 2003, and that company was dissolved on 2 December 2009. They say they are the wrong respondents for my PPI complaint.

Now I'm stuck?

1. The finance agreement was between me and Welcome Finance.
2. The agreement was brokered by Approved Car Finance on behalf of Welcome Finance.
3. I do not have any of the original PPI documentation save that the PPI amount was £1,891.30 plus "optional" insurances totalling £3,131.30 and a finance charge of £2,630.14 - I have a copy of the original signed agreement.

Who do I pursue for my PPI complaint given the date of the agreement (24 July 2002) and the fact that Direct Car Finance Limited trading as Approved Car Finance (Manchester) was dissolved in 2009? Who underwrote the PPI insurance and can I go after them.

Interestingly, Welcome's letter says that prior to 27 February 2003, when they voluntarily joined GISC, any so-called "non-regulated" insurance sales (prior to GISC membership) are the responsibility of the underwriter. I'm in contact with Aviva regarding to separated pre-2003 agreements.

The benefit of anyone's experience with old PPI claims against Welcome going back to 2002 would be appreciated.

    Whoever sold it to you is repsonsible, ACF, but since it was pre regulation and the company is dissolved, you have no-one to complain to.

    The one shot left is to find out who underwrote it [although again, they are not responsible and can dismiss your complaint] and complain to them. You may be lucky, you may not.
