bol - still waiting for order after 2 months...

I ordered 2 books from bol on the 21 March (almost 2 months ago) and these have still not yet arrived. However they charged my card for the books on the day of the order. When i contacted them they said that I had cancelled my order - this is blatantly untrue. As they took the money on the date of the order and have failed to deliver the goods after 28 days; am I correct in assumming that I am entitled to the goods I ordered at the price I ordered them at? (They have not refunded me any money and have not supplied the products ordered - breach of contract?). While I could get the books elsewhere (at full price) I don't think that this is satisfactory, given that I have been waiting for 2 months.

    If you can phone them do so, if you can't email them asking them to supply the goods in x days or you will refer the matter to your credit card issuer.

    There's a few points to be made here.

    No Money Saving Expert should ever buy anything from BOL. It's a lottery. I have and I regretted it (details elsewhere).

    However, the search engine for these forums is letting people down by not allowing people to search for 'BOL' - claiming that it's too short a phrase for searching. I don't know who's responsible for it, but we need to let them know of this problem.

    Phoning BOL is the only way to get a response. Use 0207 7606900 and ask to be put through to BOL customer services. The 0870 number will cost you (and pay them) a fortune.

    There is an address for BOL. Use google to find it as they've hidden it on their website in a place where no-one can find it.

    My credit card company - Sainsbury's Visa - refused to help me, insisting that they had no liability. I think they failed to read my letter and may be a little hard of understanding, since I never suggested they were liable. Your credit card company may be similarly helpful.

    Best thing (as suggested by consumer advice people) is to send them a short letter saying what they owe you and that in 1 week you're going to start pursuing them through legal channels. The small claims court for example. If you can get through to them on the phone though,you'll save yourself a lot of time and letter writing.

    Consumer Credit Act 1975 I think only applies to orders over £100, however your credit card company may have other protections which will be governed by your credit agreement.
