Bank-Smart

A few years ago I was contacted by Bank-Smart who are based in Truro, Cornwall about miss sold PPI.
My understanding was that their service would be free ,however if a claim was successful they would take a percentage.
I completed the forms and over the years answered their questions via the postal service.
To date there has been no success with any of the loans/ credit cards I gave details of.
Approximately 6 months ago they sent me a letter informing me to pay £61 plus £12.20 vat for a commission charge regarding Goldfish PPI.
A short time after they sent me a charge of £346.25 plus £69.25 vat invoice stating breach of contract.
I have tried to call Bank-Smart but the phone went dead, and have emailed them now 3 times, stating I would like to know the reasons why are they not answering my emails or questions.
Again this month I have received another invoice as previous months.
Lastly, in their communication by mail they are threatening debt collection and legal teams being instructed, stating I will incur further costs if I don't settle/ pay their invoice.
Any help or advise would be most appreciated.
Many thanks Julian

If you have had no success on a no win no fee contract with them, download the document at https://www.bank-smart.co.uk/ComplaintsProcedure.pdf and keep a copy.

Then send a complaint to complaints@bank-smart.co.uk

Keep copies of all the emails you send and just ignore them. If they try to take court action they will simply make themselves look silly.
  • I will post the contract up here later tonight.

I am still receiving letters with more costs. I have now rang the ombudsman. do I need to tell banksmart what is going on?

You can't involve the Ombudsman until you've given BankSmart an opportunity to resolve your concerns.
Do as Magpiecottage advises and send them a proper written complaint. If you receive no reply after eight weeks, or if you receive a reply you remain unhappy with then you can refer to the Legal Ombudsman.

Please don't bother posting up the contract on here.
