247 electrical - i want a replacement!?

brought a bosch hoover begining of jan this year - but it has developed a fault with the brush bar ( not turning all the time - therefore not cleaning properly). so i gave them a call and was told as it was not in the first 28 days i have to have a repair not a replacement. when i said it should have a one years guarantee she said yes but only for it to be repaired -its in their t&c's.
i have looked at those and it says what to do if a fault develops in the first 28 days but not what happens thereafter. it also has a list of consumer protection laws but what does that mean?
is there anything i can do?
i would be grateful for any help - so many thanks !

  • answer is the retailer is responsible for the product under the sale of goods act. the manufactuerer usually offers a year or 2 warranty which is in addiiton to your rights with the retailer.

    most retailers will fob you off to the manufacturer, but you just need to know your rights and demand them. trading standards are useful allies in this fight.

    bosch usually offer 2 year warranty on their larger products, not use regarding vacuums though.

    I would say you need to call the retailer and mention sale of goods act and trading standards and see if they are then willing to take the unit and either repair or replace it. you are not entitled to a replacement unless they cannot repair your unit in a reasonable space of time. you are not entitled to a full refund, but if they cannot repair or replace you are entitled to some refund which will be reduced for wear and tear.

    if the standard line fob you off, call the HQ - try yell.com or ask the call centre. they will usually back down and can override standard procedure.

    otherwise you could try writing/faxing the MD of the company, you could try looking on the internet for the MD's name, or ask the call centre. if you're lucky his PA will sort it out for you.

    if the retailer is being completely useless and you've tried the above, your only option would be to try the manufacturer, they might fix it free of charge as goodwill if you push them in the same way as the retailer.

    the thing to remember is it will cost the retaielr/manufacturer money either way, so they don't want to do it, you have to push over and over if they fob youi off to start with, in the end they usually fold to your demands.
    Sense is not common.

    thanks for your advice - very useful
    as yet still no news on getting my vacuum repaired - although its been a week since they said they would speak to bosch to arrange a repair!
    have emailed them again to see what is going on but still no reply - going to try again shortly. i'm loathed to keep phoning as they keep you hanging on for ages ( at national rate! )
    just seems like a case of got your money - sort out your own problem!
