Contract Race, not informed by estate agents

  • I'll still proceed but not happy at all with EA.

    You are not supposed to be happy with estate agents as a house buyer. They are working directly against your interests, as they should be.

    Sounds to me like the estate agent is doing a good job for the people who are paying him. He's getting them more money and a quick sale.

    They've apologised but apparently I'm now locked into paying the 3k because They've already told the vendor.

    Nonsense. You're not locked in at all until exchange.

    But, all you can do is say "No, my offer is £xxx (the one that's £3k less)." The vendor may refuse it. In which case you have to choose whether to proceed at the higher price or back out. As I'm guessing you don't want to do that, they've pretty well got that over the barrel.

    Never forget that the EA is the seller's agent, not your agent. They're a salesman working for the seller.
  • I keep being told by the estate agents that the contract has been /will be sent but after checking with my solicitors (this morning again) they haven't received the draft contract yet- should I be worried?
  • One question-am I allowed to contact the vendors solicitors directly? Or must I do it through my solicitors or the estate agent?

    You're allowed to try.
    Whether they speak to you, and if they do what they'll tell you, is up to them.

    Remember that they are 100% on their client's side.

    No you cannot usually speak to the other solicitor.
  • Just been told today that the contract will be sent tomorrow but it will be a contract race as I expected.
