Work Related ESA group appeal award. Backdated payments question...

    Would the backdate from 2014 though? The op was refused ESA again last year so claimed JSA from November 2015 then applied for ESA again in January16,so wouldn't the backdate only be from the 14th week after January's claim?
  • So what you're saying is if I "asked for the decision to be looked at again" in regards to switching from WRAG to SG, that I would only be backdated the difference between WRAG and SG to the date of the decision to move me to SG? That seems strange to me. Lol
    Surely if they should have placed me in the SG in the first place it should be backdated to date of the claim?
    I did call Jobcentre processing department a couple weeks ago and was advised to appeal against the decision to backdate the payments to 2014, try and get them backdated to 2011 as I shouldn't have been turned down in the first place, back then... You think that's a waste of time?
  • Poppie, that is what Citizens Advice have told me. However everybody at Jobcentre processing say it's 2014. Other than the girl today, who told me she thinks it would be January 2016...

    ues, only from the date of the decision to place you in the support group.

    it wouldn't be silly because you had already appealed the original decision not to award ESA.
    you appealed to the tribunal and was placed in the WRAG. you can't continuously appeal a decision until you get the answer you like.

    please clarify which decision the tribunal over ruled.
    what was the date of this claim?

    The Tribunal over ruled the decision to award me 0 points at my Medical Assessment.
    It's not only the answer I would like, but additionally the answer I think I should be entitled to...

    It would help as tremendously if you could give us a timeline of exactly what has happened since your very first ESA claim - including whether you asked for a mandatory reconsideration, whether it went to appeal, what happened - decision made Plus periods you were on JSA.

    We might be missing vital information which could change our advice to you.

  • @pmlindyloo Just called and they're going to send me a breakdown of my ESA claim beginning 2010/11. They said this is a repeat claim. They'll only send me information about the ESA claim, not JSA, but basically every period I haven't claimed ESA it's been JSA...
    I was also informed you need 30 points to be placed in the Support Group and only 15 (which is what I was awarded) for the Work Related Activity Group.
    Still baffles me that I got only 15 points but my pal must have got 30. My diagnosis is worse than his! I deal with things worse than him too lol.
    Forget about that anyway, can't be bothered to appeal that as well.

    admission to the support group isn't dependant on pints, so I'm not sure why anyone told you that 30 are needed.

    i am in the support group because i meet descriptor 7 ii. cannot read 16 point print and cannot read braille.
    there isn't even an indication of what problems gain which points.
