HELP. Gladstones Solicitors -Letter before claim.

Either the poster has coughed up which is understandable if you cant get to grips with the process or the poster is being assisted off forum by another member. You could send them a pm but as gladstones trolls may well infiltrate the forum you may not get a response though your own thread puts you in a similar boat. Lots of gladstones threads appearing on here and pepipoo that's shows you the stages.

I am back with the results. I won yeepee.
So after the courts wrote me and Euro parking to provide any evidence that we have 2 months ago, I did not provide anything further. But Euro did send a whole bunch of paperwork with signposts pictures , a witness statement (which did not appear solid to me ) etc.
This moved me a bit but I did not give in. Then finally got Judgement order and the main point was the Claimant has not filed evidence that the defendat parked whilst not on the premises in one of the shops there so therefore no breach of the contract. Hope this helps anyone. Thanks for the help I got.

Did you have a hearing then?

Don't tell me you didn't object to Gladstones wanting it 'heard on the papers' and that you didn't send your own Witness Statement and evidence...and it was heard with no hearing and no evidence and NO Witness Statement from you - and you still won?

Did you only use the very basic reply to LBCCC as a 'defence'? OMG you got lucky, that was not a defence and it was lucky I included this paragraph:

''I also require evidence of the contravention. If the driver is alleged not to have been a patron of the shops, I cannot be expected to know or answer to that allegation as keeper of the car. However, the burden remains with your client to produce evidence and I require that now (e.g. photographs of the driver leaving the site, if that is the allegation).''

That was not a defence and was never written to be one. You needed to come back and we would have assisted with a witness statement and evidence and explained how to insist on a hearing locally to you.

If your description is all you did, this was played totally wrong - so, can you tell us next weeks' winning lottery numbers please?!!

Or, did you have a hearing (which you should have insisted on) and won at the hearing, after filing evidence and a witness statement as the forum tells you to? Tell us more about what you did/didn't do, and which Judge & Court it was heard at.

I offer my congratulations - but do enlighten us - how on earth you did this and what was said in the defence?

Its very doubtful that they will appeal, even a win in court puts he PPCs out of pocket.

As for Parking companies reading this site, as long as you are truthful and honest then you've got nothing to worry about.
there are plenty of case summaries on the parking prankster site, here and pepipoo. Any summary form a court case is of use to those facing up to the Parking companies

If you are not yet 21 days past the hearing/order date you might want to wait but other than that, beyond that they can't appeal. We would love to hear what was/wasn't done and a link to their evidence to laugh at, and the Judge's decision.

Judge's name, claim number and court would be useful too, for others to quote as a case where the Judge found that there was no proof of the contravention.

However you achieved this - well done!
