eBay buyer dispute

Help! I recently sold an item on eBay, which ended late on Saturday 26 March. As this was the bank holiday weekend, the post office was not open on Monday 28 March, meaning the earliest opportunity to send them off would have been the following day.
Unfortunately, a new job meant I had to go away for 3 days from Tuesday 29 March - Friday, 1 April, meaning I was not in a position to post the item, which I advertised as 2nd class economy (2-3 working days). If I was in a position to post it on Tuesday, the item would have reached the buyer by Friday 1 April.
The buyer emailed me the following Saturday evening asking if I has posted the item. I explained my position, and that I would send them first thing on Monday morning 1st class. He replied asking for a refund, as he had to purchase another pair (which I find hard to believe).
I sent the item regardless (in hindsight, not the best decision, but I could not refund the money, as I no longer had the funds to repay him).
He handed it to ebay's resolution centre who in turn suggested that myself and the buyer come to some resolution, which proved fruitless. He is now claiming the item was never received, which means ebay has found in his favour and the buyer has been refunded.
As you can imagine, I am furious. This means he has a brand new item worth £60, and I am left with a negative balance on PayPal.
I have contacted eBay today, who explained that as the case is closed, the decision cannot be overturned, and the only thing that they can do is email the buyer asking if the item was received.
I know for a fact the item was received.
Can anyone tell me what my rights are?

No rights whatsoever unless you can prove it was delivered.0

You know it was received but can you prove to ebay/paypal that the buyer received it?Censorship Reigns Supreme in Troll City...0

As lovinituk says, the only way you can definitely know it arrived is with tracking and if you have tracking then entering the online details into the dispute 'might' have won the case. I say might as actually by posting it so late you are actually outside the PayPal seller protection timings.
If you don't have tracking then why on earth not- and I strongly urge you to read the sticky postage thread before you consider listing anything else.
It is also a bad idea to sell something when you are not in a position to post it. That might have been OK 5 years ago, but now timing is everything and buyers just won't accept it.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Lots of mistakes here, mainly
- failure to upload your proof to the dispute (as I assume proof means tracking, as you surely didn;t send an expensive item untracked)
- the lack of consideration in not informing your buyer about the long delay in posting
- why on earth you posted it after they asked for a refund, whether or not you believed their reasons
A lot to learn from in the future.0 -

Other than the fact OP has the money and her buyer has the item.
The fact that ebay, for marketing purposes, has reversed the transaction is neither here nor there.
OP, do you make a good living off ebay, or has ebay trying to defraud you put you off?
If you need ebay, you'll need to let them cheat you, otherwise do nothing and spend the money."Love you Dave Brooker! x"

How do they know the buyer has the item? They haven't responded to say they have proof of delivery.Brooker_Dave wrote: »Other than the fact OP has the money and her buyer has the item.

If they have proof of delivery then they should win a paypal claim. OP appears to have realised that they have misunderstood what they are doing- and I suspect it is unlikely they will bother to come back and answer of the questions raised.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. In the buyers position I would have asked for a refund too as your reasons for not dispatching on time are completely irrelevant to me. I also can't understand why you posted after the refund was requested. It was asking for trouble.
If the buyer has the item they should probably send it back.0
